A. General Provisions
1. Scope of the terms and conditions
1.1 The business relations between the customers and the online shop www.linsenmax.ch are subject without reservation to the following general terms and conditions.
1.2 The sale of products, services and offers of Linsenmax to its customers are exclusively subject to these GTC. The customer acknowledges the GTC in the version valid at the time of placing the order or using the services of Linsenmax. Linsenmax does not recognize any general terms and conditions of business of the customer. Any verbal or telephone agreements that deviate from these GTC must be confirmed in writing in order to be valid. Communications by e-mail or fax shall be deemed to be in writing. The party initiating the communication shall bear the burden of proof of receipt of the communication. Written confirmation is also required for any changes to this written form clause.
2. Delivery
2.1 For orders of CHF 100 or more, delivery is free of charge and is carried out by Post Pac Priority, within Switzerland only. For orders below CHF 100 (value of the goods), a surcharge of CHF 7 for shipping and packaging will be charged.
2.2 Shipments abroad are not possible.
2.3 The delivery is ensured according to the services of the Swiss Post. The online shop www.linsenmax.ch declines any responsibility concerning the not received sendings. Upon receipt of the goods, check that they are complete and intact. If you have a complaint about the damage of a package, please contact us immediately by sending an e-mail to fragen@linsenmax.ch. The information about the lenses you have ordered is contractual.
3. Delivery time
3.1 As a rule, Linsenmax delivers within 5 to 10 working days after receipt of payment. However, depending on the availability of the products, the delivery time can be extended.
4. Guarantee
4.1 Linsemax agrees to take back within 10 days all products purchased on the online store www.linsenmax.ch in their original condition and in their sealed packaging and refund the full purchase price.
4.2 The shipping costs of the returned products are at the customer's expense.
6. Contact lenses claims
6.1 Contact lenses for which a complaint has been made must be returned in a container suitable for contact lenses and in a suitable storage solution.
6.2 In order to make a proper return, the customer must mention: the batch number, the customer number, the order number and the correction of the lens. Only then can the supplier process the complaint.
6.3 Complaints about contact lenses that are dried out cannot be processed. No defect can be demonstrated.
6.4 The shipping costs for the return shipment shall be borne by the customer.
5. Contact lens subscription
5.1 When obtaining a contact lens subscription, the customer receives a delivery of contact lenses at regular intervals at the values stated in the order. These intervals may be three and six months and are set by the customer at the time the contract is concluded.
5.2 The initial contact lens subscription period is for a minimum of three or six months. On its expiry, the subscription extends by a further three or six months. The subscription may be cancelled at the end of the minimum period and each extension period, in writing and subject to 30 days’ notice. In the event of good cause, in particular if contact lenses are unavailable, the customer may terminate the contract with immediate effect.
5.3 Regular transmission and verification of contact lens values should be carried out. The customer must notify Linsenmax 30 days before the date of the next delivery at the latest, in writing or by email.
5.4 Linsenmax undertakes to notify the customer in the event of the non-availability of a cleaning product and/or contact lenses featured in the subscription. In the absence of a response from the customer within 10 days of notification by email, Linsenmax will replace the unavailable product with one possessing the same properties.
7. Quality
7.1 All prices are inclusive of VAT. Any shipping costs for purchases in the online store are not included in the displayed sales price and will be charged to the customer. The prices valid at the time of the order shall apply.
7.2 All prices are quoted exclusively in Swiss francs (CHF / Fr).
8. Price
Linsenmax offers various payment methods. Credit card, PostFinance Card, PostFinance E-Finance, advance payment and TWINT are the usual payment methods. Goods can also be sent by Linsenmax against invoice to selected customers (payable within 10 days). Linsenmax reserves the right to request clarification of the creditworthiness of customers. Linsenmax may exclude certain means of payment without further justification, either generally or for individual customers.

9. Means of payment
9.1 Linsenmax offers various means of payment such as credit card, PostFinance Card, TWINT, Paypal and payment by invoice.
9.2 In the case of payment by invoice, payment must be made within 30 days of receipt of the invoice. The customer receives the invoice as soon as the order is sent. Linsenmax reserves the right to request clarification of the creditworthiness of its customers. Linsenmax may exclude certain means of payment without further justification, generally or for certain customers.
9.3 In the case of payment by credit card, Paypal or Postcard, the account will be debited immediately after the notification of acceptance by Linsenmax. Credit card transactions and Paypal transactions are processed via SIX Payment Services. You can find more information about Paypal at www.paypal.com.

10. Ownership
10.1 The delivered goods remain the property of the online shop www.linsenmax.ch until the order and the delivery are completed. Changes of address must be communicated to us without delay; otherwise, the customer will bear the costs of address searches.
11. Data protection
11.1 After the conclusion of the contract, all orders are stored at Linsenmax. The customer's personal data required for the execution of the contract shall be saved in a customer account. The data is saved as soon as the customer has registered in the online store and accepted these GTC and the data protection declaration.
11.2 If the customer wishes to delete a customer account, he/she should contact our customer service by e-mail :fragen@linsenmax.ch
12. Errors
12.1 Linsenmax makes every effort to present the products shown in the online store with the greatest possible care. However, we reserve the right to make errors, misprints and changes to the technical data and colors of the products shown in the online store.
12.2 For colored lenses, the colors of the photographic reproductions may vary from reality. It must be taken into account that the result that the customer obtains will depend entirely on the natural color of his eyes. It is therefore best to discuss this with your specialist. On the other hand, we make every effort to constantly update the photos of our suppliers' packaging, but Linsenmax cannot provide a guarantee for packaging changes. Linsenmax expressly reserves the right to change its prices and products as well as its delivery conditions at short notice.
13. Applicable law and jurisdiction
13.1 Only Swiss law is applicable. The place of jurisdiction is Meyrin.
Remarks
By ordering online, the customer certifies that :
- They have been wearing contact lenses for more than 6 months without any problems
- The information about their contact lenses corresponds to the values given to them by a specialist
they respect for the recommended duration for wearing lenses - They have had a check-up with their ophthalmologist within the last 12 months and the specialist has not advised them to stop wearing lenses
- They are fully aware of their ophthalmologist's instructions regarding the care and handling of lenses
- They will stop wearing lenses immediately if they experience any discomfort and will consult their ophthalmologist
